Terms of Service
Last updated: April 16, 2026
Acceptance of Terms
By accessing or using the Daimenu platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. These Terms apply to all users, including customers and visitors.
Geographic Availability
Daimenu is available to users and merchants in all member states of the European Union. While the Platform is operated by a Bulgarian-registered company (DAISOFT LTD) and these Terms are governed by Bulgarian law, your rights as a consumer under the mandatory consumer protection laws of your EU country of residence are not affected. EU residents may also raise complaints with the relevant supervisory or consumer protection authorities in their country.
About the Platform
Daimenu is a marketplace platform that connects customers with independent local merchants (restaurants, food establishments, and shops). We provide the technology that enables you to browse menus, place orders, and make payments.
Daimenu is not a food provider, restaurant, or delivery service. The merchants listed on our platform are independent businesses solely responsible for food preparation, quality, safety, pricing, and delivery. We do not employ, manage, or control merchants or their delivery personnel.
Your Account
- You must be at least 16 years old to create an account.
- You must provide accurate and complete information during registration and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You may sign in using email/password or through a supported third-party provider (Google, Apple). By using third-party sign-in, you authorize us to access your basic profile information from that provider.
Orders
When you place an order, you enter into a direct transaction with the merchant. Daimenu facilitates this transaction but is not a party to the contract between you and the merchant.
By placing an order you agree to the following:
- Prices displayed are set by the merchant and may change without notice.
- Delivery fees and minimum order amounts are determined by each merchant individually.
- A merchant may accept, reject, or cancel your order at their discretion.
- Order details (including a snapshot of your contact information and delivery address) are shared with the merchant to fulfill your order.
Payments
The Platform supports the following payment methods:
- Cash on delivery - you pay the merchant or their delivery person directly upon receiving your order.
- Online payment - processed securely through Stripe. Depending on your device, you can pay by card, Google Pay, Apple Pay, or Revolut Pay. All payments go directly to the merchant's Stripe account. Daimenu does not store your payment details and does not charge any additional fees or commissions on payments.
- You agree that all payment information you provide is accurate and that you are authorized to use the chosen payment method.
Delivery
Deliveries are managed entirely by the merchants. Daimenu does not provide delivery services and is not responsible for delivery times, conditions, or issues. Estimated delivery times displayed on the Platform are approximate and provided by the merchant.
You are responsible for ensuring that your delivery address and contact details are accurate and complete. If a delivery fails due to incorrect information provided by you, neither Daimenu nor the merchant is obligated to provide a refund.
Cancellations and Refunds
You may request to cancel an order through the Platform. Whether a cancellation is possible depends on the order status and the merchant's policies. Once a merchant has started preparing your order, cancellation may not be available.
Refunds for cancelled orders or quality issues are handled by the merchant. For online payments, refunds are processed back through Stripe to your original payment method. Daimenu will facilitate the refund process but the final decision rests with the merchant.
Your Obligations
- Use the Platform only for lawful purposes and in accordance with these Terms.
- Do not misuse the Platform, interfere with its operation, or attempt to access it using methods other than the provided interface.
- Provide accurate delivery addresses and be available to receive your order at the specified delivery location.
- Do not create multiple accounts, impersonate others, or provide false information.
Intellectual Property
All content on the Platform - including the design, logo, text, software, and graphics - is owned by Daimenu or its licensors and is protected by intellectual property laws. Merchant content (menus, photos, descriptions) remains the property of the respective merchants. You may not copy, reproduce, or redistribute any Platform content without prior written permission.
Allergen Information Disclaimer
The Platform allows merchants to provide allergen information for their products and enables users to set allergen preferences and receive warnings. Please be aware of the following:
- All allergen information displayed on the Platform is provided solely by the respective merchant. Daimenu does not independently verify, test, or guarantee the accuracy or completeness of any allergen data.
- The allergen warning feature is provided as a convenience tool only and must not be relied upon as a substitute for professional medical advice or direct verification with the merchant.
- Neither Daimenu nor the merchants accept liability for any allergic reaction, health issue, or other harm resulting from inaccurate, incomplete, or missing allergen information.
- If you have a severe or life-threatening allergy, you must contact the merchant directly by phone or email before placing an order to confirm whether the product is safe for you.
Limitation of Liability
To the maximum extent permitted by law:
- Daimenu provides the Platform "as is" without warranties of any kind, express or implied.
- Daimenu is not liable for the quality, safety, legality, or any aspect of products or services provided by merchants.
- Daimenu is not liable for any delays, failures, or issues related to delivery, as deliveries are managed by merchants.
- Daimenu's total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid through the Platform in the 3 months preceding the claim.
Termination
You may delete your account at any time through the Platform settings or by contacting us. Upon deletion, your access will be deactivated. Certain data may be retained as described in our Privacy Policy.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Platform. We will provide notice where reasonably possible.
Data Export
You have the right to receive a copy of your personal data in a structured, machine-readable format (GDPR Article 20). You can request a data export from your Profile page. Exports include your profile information, saved addresses, and order history for a selected date range (up to 1 year).
- For date ranges up to 1 month, you can download the data directly as a JSON file.
- For longer periods, the export will be sent to your registered email address (limited to 3 email exports per day).
Right to Be Forgotten & Account Deletion
In accordance with the EU General Data Protection Regulation (GDPR), Article 17, every user has the right to request permanent deletion of their account and personal data. You can exercise this right directly from your Profile page using the "Delete Account" option.
When you delete your account:
- All personal data (name, email, phone number, delivery addresses) will be permanently and irreversibly anonymized.
- Your active sessions will be revoked and you will be logged out.
- Notifications and saved addresses will be permanently deleted.
- Personal details within all order records (name, email, phone, delivery address) will be anonymized immediately.
Certain records linked to your account cannot be deleted due to legal and accounting obligations:
- Order financial data — amounts, items, and merchant details are retained for tax and accounting purposes as required by law.
- Payment transaction references — retained for dispute resolution and financial audit compliance.
Even without account deletion, personal details within order records are automatically anonymized after 24 months. The anonymization process replaces all personally identifiable information with non-reversible placeholders, ensuring that retained records cannot be linked back to you.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Bulgaria.
Changes to These Terms
We may modify these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
